Web Of Blogging Legalities


In reading from the book "writing for digital media", the author teaches us that there are some easy ways to legally protect yourself when publishing writing material (like our blogs) online.  In addition, there are some legalities that are a bit more cumbersome and complicated but necessary to learn.

Complicated legalities include the many Privacy legislations and laws that have been enacted to protect against privacy issues in traditional publications and online publications. 

There are also many mandates that protect citizens, both private and public, from libel.  Libel and Privacy issues are two problems that are hard to manage legally and the growing number of professional and non-professional writers (like bloggers) on the internet are only making it harder to oversee and manage.

Online privacy issues include access to and selling of personal records/information, surveillance, file-sharing, and computer cookies.  As web writers (bloggers), we need to be sure that the way we gather information for anything we write does not fall afoul of the laws that protect against these issues.

Some of these laws and legislations include:
Another interesting thing I read was that almost anything written is automatically copyrighted to the original author.  Only the author has the right to alter, publish, copy, etc their written work.  So plagiarism is not only wrong, it is illegal. Who knew?

Libel is another issue that we as bloggers must guard against.  If I were to publish a writing about a person/organization, I have to make sure that I do not write something I can be sued for.

I learned that libel only occurs when information printed is untrue.  So if I am writing about a person/organization, I have to do my due diligence to make sure that it is true.

Getting at least three documented sources, doing real research and homework, and giving the person/organization I am writing about a chance to respond or defend themselves are ways to legally keep me from being sued for libel or defamation.

In the end, the most surprising thing of note in my reading of the book was that anyone, professional writers and non-professionals (like bloggers), can be sued for libel/defamation and that ignorance of the law is no defense. Who knew?

Family's View Of Personal Brand




I knew when I read our assignment that this was going to be an interesting, yet comical exercise. 

I read aloud my personal brand statement to the family right after the Thanksgiving Day dinner. 


Bellies were full from the turkey and while the tryptophan may relax and dull the senses, my family's witty sarcasm was sharp as ever.

My cousin said that it was a good thing that my cooking was way better than my brand statement.

My sister said that my 25 years of retail procurement experience was the reason I am so frugal.....she used the word "stingy" but tomayto/tomahto. 

My oldest son was too amused by the fact that I have a Twitter account now and my youngest son made a suggestion that i add in the fact that I make the best sweet potato pies.

After they all had their fun, they were impressed with my personal brand statement and my LinkedIn account page.  They didn't have any suggestions for me but did have questions about how they could go about creating a LinkedIn account. 

I spent the rest of the evening showing them the LinkedIn site and how to created their own personal blogs.  I didn't get much help that night but because of this class, I was able to help others become more interested and adept in the area of social media.

Social Misuse Fact Finding Session

In searching about some of the legal issues while using social media, I am most interested in what employers can and cannot do. Especially when done within the realm of their employees  personal time. 
I found the following information from Saper law offices. 

  • Can an employer check up on employees through social media?                                       Yes, with some limitations
      • Employers can check LinkedIn to verify information supplied by an applicant or employee on previous work history.
      • Employers can check Twitter, Facebook, MySpace, etc. for postings that may be viewed as harassment of other employees or if an employee who called in sick is really out partying
      • Employers cannot use information found on social medial to discriminate against employees or candidates due to race, religion, sexual orientation or other protected class. (Better have screening policy in place) 


Social Media & Employment
  • Employers may use social media User Generated Content  UGC for hiring/firing decisions
  • Corporate “social media policy” can prohibit employee participation, e.g.  tweets, marks/logos, use of company IT 

  • Marketing/PR positions present different rights & risks
    • ECPA and/or CFAA may protect non-consensual intrusion into third-party employee accounts 

Intellectual Property
  • Who owns the Copyright to material posted on Social Media?
      • The original author owns the copyright to their posts on Social Media.
      • If someone is hired to promote a product to friends or other users on Social Media , the Work For Hire doctrine will apply, and it is best to clarify ownership in the contract.
      • However, it should be considered that many postings may not meet the minimally creative threshold and therefore may not have Copyright protection. (Facebook Status updates? Twitter updates?)

However, there is no “law of social media,” yet!
Law evolves slowly and cannot keep up with technological change

Legacy real-world rules apply, and adapted to social stream,  otherwise unlawful practices are still illegal when online.

So what are some best practices?
    • Culture— Foster corporate culture of openness. Listen to & respect opinions of employees, customers and other stakeholders.
    • Trust— Employees should be trusted to communicate and develop relationships with customers. Do not review content prior to posting.
    • Training— Provide employee training about how to blog; review legal issues with employees. Give employees option of participation for off-hours socmedia activities.
    • Transparency— Disclose connections with customers. Reveal commercial and sponsored relationships. Transparency and authenticity are key.
    • Accuracy— Confirm facts. Check with colleagues before publishing content that will affect them. If employees write about private matters, insist upon permission before postings. 
  • I think I will inherently keep all of these things in mind if and when I start using Social Media in the work place.

Thanksgiving Advice

So if you guys haven't guessed from all my other blogs already, Thanksgiving is my favorite holiday! Obviously because of the food, but as well because of all the catch up I get to do with my family.

Usually I'm home all day, watching movies just smelling all of the delicious food get ready and wait for my brother and his family to come over. But this year I was on my way back from Atlantic City, which was even better because by the time I got home all I had to do was get dressed and get ready to eat!

So we're all at the dinner table, conversing, eating and laughing, then I remembered I had to bring up my personal brand. So I did!

I mean at first my they were all confused, but once I explained a little more they understood what I meant. Of course my joking father was the first to have input and say "No way YOU wanna work with something that deals with food? Who would of guessed?"Everyone laughed of coursed.

So I guess they agreed with me on one thing, I have a passion for food. My brother was the next one to bring up that he agreed with my dedication and drive, especially when its something I love, and he thought I'd be great at finding ways to advertise for food.

What he did give advice on was on my LinkedIn page, which me and him are friends on. He said based on what I had just mentioned to them about my personal brand I should begin to network more with my cousin who works for BakeMart and get interact more with their marketing executives and see if they have any advice for me.

Everyone else seemed to agree with my personal brand, some even said they had already seen me having some type of career where I dealt with food in some type of way.

Thanksgiving is always a great holiday in my family. My father being the youngest of 5 and myself being one of 13 grand kids it is not a small get together to say the least.

There are quite a few comical personalities at the table that love to voice their opinion on any topic whether it is welcomed or not.
So you can imagine the reaction I got when we finished dinner and I attempted to share my personal brand with the fam.
I felt like a failing comedian being booed off the stage after a terrible performance. But once I got their attention (well half anyway) I ran through my brand statement.
For the ones that actually listened they all said that it portrays my personality very well, but then my uncle Doug laughed and claimed I’m wasting my time with that “social media crap.” Clearly a man living in the past and not aware of the huge benefits it does bring to the table.
But since we were at the dinner table he took the opportunity to poke fun at the situation and attempt to steal my limelight, unfortunately for him I am far more clever and quick witted and returned fire with a comment that will go unmentioned but let’s just say, Josh 1 Uncle Doug 0.
Hence, Determination yet again.

Trashing up


The Clean up for the old and long blogs was really helpful, as it has made me a better blogger. The long paragraphs and big pictures with the different writing styles looked unprofessional.

The cleaning has made us improve our blog and attract the audience for a better projection of the profiles.

The writing fonts and the two line sentences for the blogs makes it look professional and better for the audience to read the main context of the blog and attract more readers.

The knowledge has also helped us in making a better linked in profiles and cutting down the content on other social media websites for the professional look.

Deleting old posts has really helped in making a better blog and improves other social media pages to develop professionally, and to market us in the world of social media age.

I have realized that the best way to target the audience is through social media like Linked In and other social media Websites.

The brand that stands out will attract the audience, and this should be done by engaging your personal profile in blogs of other people and asking for their opinion.


Driving the Perfect crowd to your linkedin profile can be challenging, so the best way is to start marketing your profile through friends and family and use the connections to develop more contacts.

Engaging the audience will lead to future job opportunities, gaining more knowledge about your industry and can lead to an Entrepreneurship.

Creating the Professional contact will lead to a strong relationship with the future employee for better job prospects.

One of the main things is to drive the right audience to the personal page by creating a Common interests, following them through twitter and other social media by their likes and dislikes.

Following blogs to certain Websites could lead to opportunities which one might have never imagined, you could find people just by following certain blogs on websites like Washington Post and New York Times. This would lead to common and different opinions, and discussions.

Thus engaging the audience to the personal brand will lead to improvement in confidence and will be beneficial in achieving personal goals.

Ad Libs For Mad Libs




I am a triple-threat of ________ (adjective), ________ (adjective) and ________ (adjective) flair. One that has ________ (verb) determination for ________ (noun) and ________ (noun) success through taking initiative and outside-of-the-box thinking in a fervent way.

Up until I was about 12yrs old, Thanksgiving dinners always had a twist of entertainment – thanks to my sister and I. We’d “perform” magic tricks that would normally end in one of us crying because someone in the family would laugh at how “cute” our tricks were.

As time went by and we grew up, my nephew became our successor. So now family get-togethers is a whirlwind of Mad Libs entertainment…which is exactly what he turned my brand into.

And what did everyone throw into Jenn Olivencia’s Mad Libs word bin?

Creative, unconventional, methodical, M&M’s, art and persevering.

Oh, and we can’t forget “mean” as per my nephew. And that’s because I refuse to get him video games for birthdays and Christmas.

As for the adjectives my family said about me, we all are in harmony with what I think about myself and what they think of me.

I’ve never asked my family what they really think of me and it was pretty interesting to hear the different verbs and adjectives they associate me with and also to receive accolades on my journey for personal and career growth.

My parents and I aren’t very close to each other, so to hear them say I was persevering and bona fide made me beam inside.

Little do they know, they are my silent inspirations, so it’s very imperative to me that I keep on suceeding.

Applying this to my personal brand won’t be complicated because it’s the attributes that I pretty much possess. I guess the only thing I can try to flexibly mold myself to is my nephews request of being a more “cool” aunt.

Family Advice

So during my thanksgiving time in Dallas TX, I went on to get feedback from my Famaly menbers about mt personal brand.

There were a wide range of answers from suport to critizizm but I tried to focus on getting the best ones that will help develop my personal brand to the level that I desire.

One feedback I recieved from an uncle was that I should try to find other ways to interact with my target adieace other that solely focusing on social media.

Since Ill be dealing with a pretty wide range age group that did seem like it made sense. A lot of kids don't strictly depend on social media to get advice and tips.


Another Feedback i received from a cousin was based on how he admired my personal brand and that it made sense for me to give back to kids what was once given to me.

He also felt that I should incorporate that idea of unselfishness towards my brand to show an even more positive nature of my personal brand. (I plan to really focus on this idea because I felt that this was the best feedback I have gotten.)

Another feedback I obtained from a family member was that it was a great idea and that the use of social media is an excellent way to attract the attention of my target audience because nowadays that where they all hang out.

It helps fuel my cause as a marketer. I want to get the word out and help fuel a desire to be environmentally conscientious.

Cleaning the Corporate House

Cleaning up our blog. I have now deleted and made some changes to my blog posts.
We want a uniform look and feel to our blog, so I've deleted some of my "drafts" if you will.

Look and feel is important to our blog as is it to any company's collaboration of sales tools.
Whether it is a sales presentation or collateral leave behind, everything should fall under a "corporate" look and feel.

While doing marketing for a smart grid technology company, I was tasked to clean up our current portfolio of sales tools.

I took apart our collateral, and rebuilt it within a theme.
I did the same for the powerpoints.

Version control is an important aspect in doing this.
You can't have different members within the company using different versions of these tools.
How do you control these things?

Well I'll tell you that I implemented a central point of contact. I used our Intranet as the On Demand Download center.

Everything our sales team or other users of the tools needed could be found on the Intranet. They could rely on getting their source material from one central location.

Updated versions always had the priority of getting posted on the Intranet. This way, these people could relay on the fact that the most current version was updated and uploaded for them to use on that site.

We also had access to new collateral from this site. It was called our On Demand Brochure system. They could always order more collateral right from the Intranet site.

They could specify shipping times/dates along with the quantity needed.

We also gave a style guide and posted it on the Intranet website. The style guide included guidelines that we wanted in order to keep a certain look and feel.

The guidelines included: font types, Powerpoint guidelines for graphs & charts, color schemes, Pantone colors (PMS), correct logo usage, just to name a few.

These are all very important attributes to a company's look and feel, which is why it is a very good habbit to get into while doing the blog in this class. I guarantee that it won't be the last time you see an attempt for uniformity.

Let's Talk While You Eat.


For the first time, I was scheduled to work on thanksgiving day. Work made me missed getting dinner done with my brothers, or as my mom calls it “bonding time”.

But even though I didn’t get the chance to help out, I was in time for dinner and I even made it before my aunts, uncles, and cousins got to the house.

I have a big family and ever since I turned fifteen and moved to the adult table, I hear the same “remember that time” stories. It gets a little boring sometimes.

Well this year was different, while everybody was too busy eating and remembering the old times I decided to announce my personal brand.

Everybody was actually glad that I was talking about how I was doing in school, it reminded them that there are a few more weeks till im done.

My mom sort of knew about my blogging, but when I told her about my linkedin and twitter, she seemed very interested and even told me that what I had in mind was a good idea.

she also reminded me why she keeps telling me to make connections thru work and why I must engage myself with people who I think will help me in the future.

My aunt understood, agreed with all of the characteristics that I picked to described myself, gave me a phone number and email address of a person who she feels will be able to get me more involved in the business that im aiming to.

Which reminds me- I need to contact her as soon as possible.

My dad has never really been a social media guy, he’s old-fashioned. But after explaining it to him. He was glad to hear that I actually want to be my own boss, and not work for anyone else.

He likes to see that im planning ahead and is actually looking forward to see me put my goals into action.

The rest of the family gave me positive feedback as well, some didn’t really understand what I was talking about and just changed the topic.

But I personally didn’t really care if the rest liked my personal brand or not. I was just glad that my parents did because I want them to see that they’ve made a good investment with me.

Open Forum at the Dinner Table

So it went a little like this…

Everyone was talking at the same time. My brothers, my sister, my mother and a few friends of the family all had something to say.

I was pretty nervous about the whole thing. I took a deep breath and asked everyone to feel free to give me their thought about how I was promoting my Personal Brand.

The first reaction I got were confused faces no one really knew what I was talking about. I just threw the topic into discussion while everyone was distracted just to get their attention and hey, it worked!

After I had everyone’s attention I began describing “My Personal Brand” and how I felt it should be portrayed. Nervous and all I managed to clearly let them know what I had posted for our class blog.

Soon enough everyone decided to comment. Some of them were quite the jokesters about it, but in the end I received very positive feedback.

For the most part, my mother and my sister are very supportive and they were very proud of the fact that I stated, “I go above and beyond to help others”.

One of my brothers insisted I should touch more on the subject about me being “bossy” since I push to constantly get things done. My interpretation of his “bossy” was that I am determined and I don’t like to procrastinate.

My youngest brother’s response to my brand was, “yea ok”. He’s the joker that only admits that I am all these great things, but ONLY when were alone.

In a crowd of people he doesn’t really like to show his sweet side, but I know if I ask him again in a few years when he’s older with any crowd he will proudly advocate for me.

As for the friends we had over, because of the fact that every time they come over I am either getting home from work or leaving for school. They were happy to agree with how determined I am to do what I have to do.

Everyone’s responses were appreciated and I informed them I would mention them all on my next class blog. This is where they all wanted to know what I had to say about them.

What Lady Gaga, Turkey, and Personal Branding Have in Common

Discussing business during family time has always been taboo in my family. It's no surprise that discussing my personal brand with them during Thanksgiving was no easy task, but Lady Gaga definitely helped.

Lady Gaga, to me, has always been an inspiration for personal branding. Not because she's controversial or provocative, but because she has always stayed true to her personal brand.

In one segment of her special, A Very Gaga Thanksgiving, she made a couple of interesting points that summed up the consistency of her personal brand: she loves fashion and she loves music, and she does what she loves for her fans and her family.

This intimate conversation on national television gave me the perfect opportunity to bring my own personal brand up to my family and friends.

Everyone had the same consensus: the "eccentric" part of the eccentric marketing apprentice definitely fit.

My one cousin said marketing is perfect for me because I can "convince anyone that even murder is a good idea, so you should be good at selling things."

My brother proceeded to call me a nerd, so I assume that the apprentice aspect was accurate as well.

On Facebook, many of my friends noted that I should include my work ethic in my personal brand because it's always been an important part of my personality. One friend also mentioned that my stubbornness should fit in there somewhere as well, I responded in telling him I'm too stubborn to add that.

I am going to make sure to include my work ethic in my Linked-In as suggested. All in all, I believe it's safe to assume that I was on-point in creating my personal brand.

Gobble! Gobble!

As everyone had their mouths full on Thanksgiving, the table was silent. I thought it would be a great opportunity (apparently so did everyone else in the class) to talk to my family about what's been going on in my classes.

I was telling them about my personal brand and how I need to get my name out there more with the use of social media. I told them how I've created Twitter and LinkedIn accounts to do this.

My mom thought it was a great idea and thought I described myself accurately. My dad, on the other hand, thought I needed to include the fact that I'm super organized with everything I do.

I guess that can be a good or bad thing.

However, I agreed with him that maybe I do have a slight case of OCD when it comes to being organized. But who wants a messy work area? Or forgets where they put things? No company wants an unorganized, sloppy mess working for them.

I realized making my LinkedIn account was the first step, now connecting with employees from advertising and marketing agencies I could possibly work for in the future is the next step.

So continuing with the Thanksgiving spirit, I'm thankful to have a family that supports any decision I make. They know what I want to get out of life and that I'll go through great lengths to get it.

Turkey and Talk

All holidays with my family can get just a little crazy, so finding the opportune time to discuss 'my personal brand' was quite difficult.

I approached my mother first while we were cooking earlier that day, which was still hectic to say the least. I discussed what a personal brand was first to get her to understand what input I needed from her. I told her that my personal brand was about how I am a very hard worker, I do things the first time they are asked of me, I work well with others as well as individually, and how I believe I can be an ideal employee to a company.

Her reaction was hesitant at first, but then came around to understanding the concept and agreed all the things I listed I am. She sees me go from work to school, to homework every night. She knows I'm a dedicated person with a lot to offer. As she and I were running around the kitchen that was the last of our conversation of it.

I next moved on to my uncle, who I actually do work with daily. He, from seeing it first hand, said I should even add more to it. He says he wishes all employees can be as attentive and responsible as I am, and not only because I'm his niece but as a colleague.

I have to admit that was the last of the talk of my personal brand at Thanksgiving, between food and drinks and more food and more drinks, it just slipped my mind.

However, I did ask my cousin to look over my LinkedIn page when she got a chance and see if she would change anything or if she has any opinions for me to jazz it up for future employers. Again this was the the food and drinks mix, so I will keep reminding her until she gets back to me.

I will take into consideration what my mother and uncle said and see if I can add to my personal brand to make it more appealing to future employers.

Family Time and Personal Brands

So although I was stuck working Thanksgiving night, I was able to have a great holiday with tons of food before heading to work. So after dinner I started talking to my mom and sister about this class and our personal brand assignments we have been working on.

Being that my mom and sister know me better then anyone else, I would take their opinions over anyone's and after telling them about my personal brand they felt that I did a pretty good job.

However one thing my mom pointed out to me that I never mentioned any where through out my personal brand statement, is that I am very loyal.

To give you a little background of myself, I have been working since I was 15 years old. I started by just babysitting, and then got my first real job as a cashier at restaurant. I ended up staying with that job for 5 years and had gotten many promotions along the way.

My next job, which I am currently still working, I have been at for 4 years. So my mom had brought to my attention that I should include the fact that I am very loyal to companies that I work for into my personal brand statement.

I feel like this was a good exercise because that is something I may have never thought of and feel that loyalty to a company is something that employers would like to have with their employees.

Interacting with My Target Audience


After thinking about how to engage my target audience, I decided that Linked In would be a good way to start. So like I have said in previous posts, until taking this course, I have never used Linked In before.

However, after playing with the site for the past few weeks, I feel like I find my self wondering how I have not gotten on the site sooner.

So I went and signed in to my Linked In account and started to try to connect with as many professionals in my future field and others, with the hopes that connecting with them may somehow help me down the line to get to where I want to be.

Then I searched groups in my related fields such as professional sports teams and accounting firms, and also companies who are looking for interns.

To drive my target audiences to my Facebook, Twitter, and my Linked In I feel like connecting with professionals who are successful in my dream field and by sending out resumes that include my Linked In profile address so companies can check out my profile to see what I have to offer.

Something special I can give my target audience that illustrates my personal brand? Well that is something that I am a little unsure of right now, but hopefully the more work I put into my personal brand I will be able to come up with something special that will more clearly show my target audiences my personal brand.

So I am really hoping that with time I can start engaging more with these companies and professionals and in turn it will help me create a good future and career path for myself.

Searching for Jessica


Outline the demographic of your target audience:

So considering how I am an Accounting Major with hopes of jumping into the sports industry I feel like I have a few target audiences that can get me where I want to be.

I believe professionals in the sports and accounting industries are both two target audiences that I can target together or separately.

Considering how even though I would love to be an accountant in the sports industry, I am not ruling out being an accountant for another company not sports related.

Also, some of my other target audiences would be any companies offering internships in their accounting departments so that I will be able to acquire experience, and potential companies that can view my Linked In profile.

Considering how I am only a semester away from graduating I have already began trying to connect and engage with my target audiences.

I have been connecting with companies and people on Linked IN relating to the accounting and sports industry.

Also, I have been on such websites like jobsinsports.com and on major league sports teams official websites in order to try and obtain an internship.
